In a ruling issued by the Swiss Federal Court, it was determined that there is no legal impediment to forcibly deporting an Eritrean immigrant who has been denied asylum. The immigrant, a married woman in her early thirties, filed a request for asylum in Switzerland after she claimed to have deserted military service at the age of 29.

The court ruled that, in light of the contradictions in her testimony, it can be concluded that the woman did not desert military service, but left Eritrea after completing her national service and was released in a regular manner.

The court also ruled that, although national service can be extended indefinitely, in practice it continues for an average of only 5-10 years. Moreover, based on a large number of reports and sources, the court estimated that women, especially married ones, are usually released after a shorter period of service.



In light of these findings, it was determined that Eritrean immigrants who have left Eritrea after completing national service can be forcibly deported, as there is no evidence of danger existing in Eritrea.

The ruling adopted the conclusion of the European Court of Human Rights published in June this year, which states that there is nothing in principle preventing the deportation of Eritrean immigrants who have no grounds for asylum.

The latest ruling joins a number of similar ones coming out of Swiss federal courts in recent months regarding asylum applications by Eritreans. However, this latest ruling is the first that adopts the position of the European Asylum Support Office (EASO), which establishes that Eritrean migrants who have been abroad for a number of years and who have paid their country’s embassy a 2% income tax should be able to return to their country without fear.



Although government reports by a number of European countries, including Norway, the United Kingdom and the Netherlands, have drawn similar conclusions in the last two years, this is the first time that a senior court of a European country has adopted the conclusions of these reports. The ruling is final and cannot be appealed.

Yonatan Yakobovitz of the Israeli Immigration Policy Center said that “The Swiss court is adopting the position that emerges from a large number of reports written by European governments and bodies in recent years. The time has come for the Israeli government, too, to begin implementing a policy based on the extensive information accumulated on Eritrea, as well as on the legal precedents emanating from the European Union on the matter, and to work to return Eritrean infiltrators who have no grounds for asylum back to their places of origin.”

“In light of the Supreme Court’s recent ruling regarding deportation to third countries, this is not only possible, but also required. “

Israel’s Supreme Court ruled last week that while illegal infiltrators may be imprisoned and persuaded to leave, they can be kept in prison for only two months and may not be deported against their will. Israel has agreements with several African countries who are willing to accept the illegals, but the Supreme Court tied the hands of the Interior Ministry by stipulating consent.

  1. What is so amusing is that this is the same government who was encouraging youth, especially the draft dodgers to abandon their country and get automatic asylum. Now, after the migration crisis took a toll on their economy coupled with intensification of terrorism on their land they are turning their back on the very people whom they promised the sky. Therefore, where is the crime in refusing forceful deportation involving such case? The Swiss and all other countries who willingly opened their doors to immigrants should honor their promise and treat them with respect they duly deserve.     1. Not only that, the Eritrean government has the option not to accept those who are FORCED to go back to their country. Why accept people who have broken the Eritrean law and receive them with arms stretched when they have been vilifying the country and government of Eritrea and UNWILLING to go back to Eritrea?       1. I totally agree with you that Eritrea should not accept forced deports. As someone pointed out in this forum sometime ago many EU countries like Germany don’t give any sort of rights (legal or economic). Once they designate them for deportation, the people will not get any compensation, except the one way ticket. My point, they have hidden agenda as to why they are pushing for this now. When things turned to be out of control the EU panicked by the influx of refugees and now they are trying to cope with the de facto situation.   2. The goal of the proudly disciplined struggle of the people of Eritrea has always been, among others, proving the adversaries that they are wrong and Eritrea is right. Assertive but not vindictive. Eritrea was merciful including to the merciless, brutal soldiers of the enemies with all of their sophisticated weapons who actually executed, tortured, displaced Eritreans at the Order of the leadership of the enemy. Once they were captured and became POW, they were treated not only humanely but friendly. They were literally living the same quality of life as the Eritrean Freedom Fighters, eating the same food and receiving the same medical treatment.

    There is no reason to believe that the goal in this case would be different. The fact that Europe is changing position in respect of Eritrea, from demonizing Eritrea as oppressive, totalitarian, human rights violator etc. TO Eritrea is a safe
    Nation and therefore Eritrean asylum seekers can go home; in and of itself is victory on the part of Eritrea (and it’s worth mentioning that Eritrea was safe and did not change; THEY CHANGED their position. Eritrea is also aware the actual reason for changing position).

    The focus of the next step should also be same by making the West understand and respect Eritrea’s Policy of accepting only voluntary repatriation. Hence the focus cannot be whether the actual Eritreans (as opposed to the thousands non-Eritreans who made false refugee claim disguised as Eritreans) vilified Eritrea. No refuge claimant ever said nice things about his/her native nation in the process of trying to have his/her claim granted in accordance with the Geneva Convention. That’s not to say that some Eritreans who went too far including by shouting slogans against Eritrea on streets of the West and on social medial should not be hold accountable and expected to show true remorse for their conducts. Otherwise Eritrea is welcoming Nation; and Eritreans who want to return voluntarily will be embraced with love and, like all proudly patriotic citizens of Eritrea; they have a duty to sand with Eritrea.

    1. I agree with you mostly. However, you have to understand the Western way of thinking. They see the world as costs and benefits. As they see it, the self inflicted immigration crises as costing them too much in terms of demographic change and expenses incurred to take care of the migrants.
      I think Eritrea should take advantage of the changes taking place in Europe. The Europeans should invest in Eritrea so that the deportees would be employed in Eritrea therefore would not need to back migrate to Europe. Eritrea should accept it’s citizens and work with the Europeans. Tit for tat is not a solution. Europeans have immigration crises and Eritrea has emigration crises. Sound solution to the problem is what is needed. If Eritrea is not going to work with the Europeans, then the Europeans would dump the Eritrean immigrants to other African country that would oblige for small incentives, countries such as Ethiopia. I think the best thing for Eritrean government to do is to take care of it’s citizens regardless of politics for the sake of our nation.
